Terms of Service

The Service lets you generate short videos from a topic or script, including automatic voiceover, caption alignment, and export in multiple aspect ratios. Features evolve over time and may be added, changed, or removed.

The Service is a tool. You operate it from your own account, you decide what to generate, and you decide whether, where, and how to publish the results. You — not Media Buddy — are the author and publisher of your videos.

You must be at least 18 years old, or the age of majority in your place of residence, to use the Service. If you use the Service on behalf of a business or organization, you confirm you are authorized to bind it to these Terms.

You register with an email address and a password. You are responsible for keeping your password secure and for all activity that happens under your account.

You must give accurate account information. If you believe your account has been accessed without your permission, contact hello@media-buddy.com promptly.

The Service is paid for with credits on a pay-as-you-go basis. You top up credits in advance and spend them as you generate content. There is no subscription and no automatic recurring charge — you are only ever charged for the credits you choose to buy.

Prices and the credit cost of each action are shown in the app at the time of purchase or use, and may change for future purchases. Changes do not affect credits you have already bought.

Payments are handled by a third-party payment provider. We do not receive or store your full payment-card details. Depending on your region, applicable taxes may be added at checkout.

Credits have no cash value except as required by law, are tied to your account, and are consumed as you use the Service. Refund handling is described in the Refund Policy.

Because the Service is pay-as-you-go, you are only charged for credits you buy. If a generation fails on our side, we do not charge you for it, and credits reserved for a failed job are returned. Once credits are successfully used to generate content, they are consumed. Full details, including how to request a refund, are in the Refund Policy.

You are responsible for what you generate and publish. You must not use the Service to:

• create content that is unlawful, or that infringes the intellectual-property, privacy, publicity, or other rights of any third party
• create pornographic content, sexual content involving minors, or violent, hateful, harassing, or discriminatory content
• create deepfakes or impersonations of real people (including public figures) in a misleading or harmful way, or without the rights and consents required by law
• create content that is deceptive, fraudulent, defamatory, or that promotes scams, pyramid schemes, or spam
• break, probe, overload, or reverse-engineer the Service or its security, or use it through unauthorized automated means
• resell, sublicense, or provide the Service to third parties except as expressly permitted

You must also follow the rules of any platform where you publish (for example YouTube, TikTok, or Instagram). Complying with those platforms is your responsibility.

Your inputs. You are responsible for everything you put into the Service — the topics, scripts, prompts, text, images, or other material you provide ("Your Inputs"). You represent and warrant that you own or have all rights and permissions needed to use Your Inputs, and that Your Inputs and the content you generate from them do not infringe or violate anyone else's rights or any law.

You review before you publish. Content is generated by automated and AI systems and can be inaccurate, incomplete, misleading, or unintentionally similar to existing material. You are responsible for reviewing, editing, fact-checking, and clearing the content before you use or publish it, and for adding any labels or disclosures (for example an "AI-generated" notice) that law or platform rules require.

Licence to run the Service. So that we can operate the Service for you, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, process, and transmit Your Inputs and the content you generate, solely to provide and support the Service. We do not use your content to train AI models, and we do not sell it. Content is processed and stored temporarily and is automatically deleted after the applicable retention period; see the Privacy Policy.

You indemnify us. You agree to defend, indemnify, and hold harmless Media Buddy and its officers, employees, and providers from any claim, loss, liability, or cost (including reasonable legal fees) arising out of Your Inputs, the content you generate or publish, your use of the Service, or your breach of these Terms or of any third party's rights.

No guarantee of output. The content the Service generates is provided "as is". We do not guarantee that it is accurate, original, suitable for any purpose, or free of similarity to third-party material. Like all AI tools, the Service can make mistakes. Deciding whether a result is fit to use is your responsibility (see Section 7).

Stock media and music. Some videos may include stock footage, images, or music made available through the Service for use within videos you create on the Service. We do not transfer ownership of that material to you, and your right to use it is limited to videos produced through the Service. Music is optional and can be turned off, and the available media may change over time.

Platform content-matching. Third-party platforms run their own automated content-identification and rights systems (for example YouTube Content ID). A platform may flag, mute, block, demonetize, or remove a video for reasons entirely within that platform's control. That platform behaviour is outside our control and is not a defect in the Service, and we are not responsible for it.

The Media Buddy name, brand, website, application, copy, visual design, source code, and documentation are owned by RUSSEL INTERNATIONAL CO., LIMITED and protected by copyright and trademark law. These Terms grant you no rights in them beyond using the Service as intended.

Subject to your compliance with these Terms and to any third-party rights in stock media, we do not claim ownership of the finished videos you generate from Your Inputs — you may use them for your own purposes.

We work to keep the Service reliable but do not commit to any specific uptime or service level. The Service may be unavailable from time to time because of maintenance, third-party outages (for example hosting, database, storage, payment, or AI providers), or events beyond our control. We may change, suspend, or discontinue features at any time.

You may stop using the Service and delete your account at any time.

We may suspend or terminate your account if you materially breach these Terms (including Section 6, Acceptable Use), if required by law, or to protect the Service, other users, or third parties. Where a breach is serious — for example unlawful or infringing use — we may suspend or terminate immediately and without refund. Where practical we will tell you the reason.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or content, arising out of or relating to the Service or the content generated through it.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for credits in the three (3) months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory consumer-protection rights.

These Terms are governed by the laws of Hong Kong, and the courts of Hong Kong have exclusive jurisdiction over any dispute arising out of or relating to them or to the Service. This does not remove any mandatory consumer-protection rights, or the right to bring proceedings in the courts, of the country or place where you live.

Before starting formal proceedings, we both agree to try in good faith to resolve any dispute by contacting hello@media-buddy.com.

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example by email or an in-app notice) before they take effect, and where appropriate ask you to accept the updated Terms. Minor changes (such as wording fixes or updated company details) update the "Last updated" date without separate notice.

If you do not accept updated Terms, you should stop using the Service. Continued use after the changes take effect means you accept them.
